We are committed to processing personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (the General Data Protection Regulation, hereinafter "GDPR") and the Polish Act of 10 May 2018 on the Protection of Personal Data (Ustawa z dnia 10 maja 2018 r. o ochronie danych osobowych, Journal of Laws 2018, item 1000, as amended).

2. Scope of This Policy

This Privacy Policy applies to all personal data collected, processed, and stored by Hojage Xutaka through the use of the website hojage-xutaka.info, through contact forms, email correspondence, telephone contact, webinar registration, and mailing list subscription. It describes the nature of the data we collect, the purposes and legal grounds for processing, the duration of retention, and the rights available to you as a data subject.

This Policy does not apply to third-party websites that may be linked from our website. We encourage you to review the privacy policies of any third-party services you access.

3. Data We Collect

We collect the following categories of personal data:

3.1 Data provided voluntarily through contact forms: Full name, email address, telephone number, and the content of the message submitted.

3.2 Data provided through mailing list subscription: Email address and, where provided, name.

3.3 Data collected automatically through website use: IP address, browser type and version, operating system, pages visited, time and duration of visit, referring URL. This data is collected through cookies and similar technologies as described in Section 10.

3.4 Data provided in the context of webinar participation: Name, email address, and any information voluntarily shared during live sessions.

We do not collect special categories of personal data as defined in Article 9 of the GDPR (such as health data, racial or ethnic origin, religious beliefs, or biometric data) unless expressly and voluntarily disclosed by the data subject.

4. Legal Basis for Processing

We process personal data on the following legal grounds as defined in Article 6 of the GDPR:

Article 6(1)(a) - Consent: Where you have given us explicit consent to process your data for a specific purpose, such as subscribing to our mailing list or accepting non-essential cookies. You may withdraw consent at any time without affecting the lawfulness of processing carried out prior to withdrawal.

Article 6(1)(b) - Contractual necessity: Where processing is necessary for the performance of a contract to which you are a party, or in order to take steps at your request prior to entering into a contract, such as processing your registration for a webinar.

Article 6(1)(c) - Legal obligation: Where processing is necessary for compliance with a legal obligation to which we are subject under Polish or European Union law.

Article 6(1)(f) - Legitimate interests: Where processing is necessary for the purposes of our legitimate interests or those of a third party, provided those interests are not overridden by your interests or fundamental rights. This includes processing for website security, fraud prevention, and improving our services.

5. Purposes of Processing

We process personal data for the following purposes:

5.1 Responding to enquiries submitted via the contact form or by email or telephone.

5.2 Administering webinar registrations and providing access to live sessions.

5.3 Sending informational updates about upcoming webinar sessions to subscribers who have given consent.

5.4 Maintaining the technical security and performance of the website.

5.5 Complying with applicable legal obligations, including record-keeping requirements.

5.6 Analysing website usage to improve the user experience and content offered, using anonymised or aggregated data where possible.

6. Data Retention

We retain personal data only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable law.

Contact form submissions and related correspondence are retained for a period of up to 24 months from the date of last contact, after which they are securely deleted unless further retention is required by law or legitimate business need.

Mailing list subscriber data is retained until the subscriber withdraws consent or requests deletion. We review mailing list data periodically and remove inactive records.

Website usage data collected through analytics cookies is retained in accordance with the settings of the relevant analytics service, typically for a period not exceeding 26 months.

Webinar participation records may be retained for up to 36 months for administrative and quality improvement purposes.

7. Data Sharing

We do not sell, rent, or trade personal data with third parties for their own marketing purposes.

We may share personal data with the following categories of recipients:

Service providers: Third-party providers who assist us in operating the website, hosting data, delivering email communications, and providing webinar platform services. These providers act as data processors under Article 28 of the GDPR and are bound by appropriate data processing agreements.

Legal authorities: Where we are required to disclose personal data to competent authorities by applicable law, court order, or regulatory requirement, including Polish supervisory authorities and law enforcement bodies.

All third-party processors are selected with care and are required to maintain appropriate technical and organisational measures to protect personal data.

8. International Transfers

Where personal data is transferred to countries outside the European Economic Area (EEA), we ensure that appropriate safeguards are in place in accordance with Chapter V of the GDPR. These may include Standard Contractual Clauses approved by the European Commission, adequacy decisions, or other recognised transfer mechanisms.

Where we use third-party services that may process data outside the EEA, we conduct due diligence to confirm that adequate protections are in place and document those safeguards as required.

Right to restriction of processing (Article 18 GDPR): You may request that we restrict the processing of your personal data in specified circumstances.

Right to data portability (Article 20 GDPR): Where processing is based on consent or contract and carried out by automated means, you may request that we provide your data in a structured, commonly used, and machine-readable format.

Our website and webinar services are not directed at children under the age of 16. We do not knowingly collect personal data from children under 16.
